A licence granted under the Factories Act, 1948 stays valid only for the period it was issued for, and section 119(5) requires it to be obtained afresh after expiry. LexComply tracks that date, and any renewal your State's rules require.

How Factory License Registration Works With LexComply

Factory Applicability Check

We count your workers against the OSH Code thresholds, establish whether a manufacturing process runs with or without power, and confirm which authority your State has designated for factory licences. The output is a written note on whether you need a licence and where to apply.

Document Preparation

We prepare the set your State's rules require, including occupier and manager details, premises and ownership proofs, site plans, the manufacturing process description, power load and worker numbers, and we check each one against that authority's own published format before anything is filed.

Filing With the State Authority

We file the application electronically with the designated authority and track it against the 45 days section 119(4) allows, after which the Code treats the licence as deemed issued. We respond to each query and record every submission and acknowledgement we make for your audit trail.

Inspection Readiness

Where your State's authority inspects before granting, we prepare the premises file the inspector will ask to see and brief your plant team on what is checked, so a visit confirms what the application already says rather than raising new questions about the factory.

Validity and Change Tracking

Your licence then sits in LexComply's compliance platform alongside every other obligation your factory carries in India. Validity dates, any renewal your State's rules require and every change you must report are tracked, so the licence stays valid for every site you operate.

Is outside support worth it

When a Factory License Needs a Specialist

A single plant in one State with a stable workforce can often apply through the State's online portal without help. A specialist earns its place when you run plants in several States with different rules, when your worker count sits near the 20 or 40 threshold, or when licences granted under the repealed Factories Act are coming up for a fresh application. That is the output LexComply produces: applicability confirmed in writing, applications filed in each State's format, and every licence tracked for validity and reportable changes inside one compliance register.

Factory License Consultant FAQs

What does a factory license consultant do?

A factory license consultant confirms whether your premises is a factory under the OSH Code, 2020, prepares the licence application in your State's format, files it with the designated authority and handles queries until the licence is issued. LexComply also tracks each licence's validity and the changes you must report in its compliance platform.

Is the Factories Act, 1948 still in force?

No. The Occupational Safety, Health and Working Conditions Code, 2020 came into force on 21 November 2025 and repealed the Factories Act, 1948. Factory licences are now issued under section 119 of the Code, under rules each State Government makes.

Who needs a factory licence in India?

Premises where 20 or more workers work with the aid of power, or 40 or more without power, on any day of the preceding twelve months, while a manufacturing process is carried on, meet the OSH Code definition of a factory, unless a State law in force before the Code set a different number. LexComply confirms where your premises stands.

Can a factory license consultant help with an old Factories Act licence?

Yes. Under section 119(5) of the OSH Code, a licence obtained under an earlier Central labour law is treated as issued under the Code, but only for the period it was issued for. A fresh licence is needed after it expires, and LexComply tracks that date and files in time.

How long does a factory licence take?

Section 119(4) of the OSH Code requires the designated authority to issue the licence within 45 days of receiving the application. If it does not, the licence is deemed issued and is generated automatically. Your timeline also depends on how complete the application is when it is filed.

What are the factory license consultant fees?

There are two parts. The government fee is prescribed by your State's rules and usually depends on worker numbers and power load. The professional fee depends on how many factories and States are involved. LexComply quotes both before work starts.

Do I need a factory license consultant, or can my team apply?

Many single-site manufacturers apply through their State portal directly. A factory license consultant is worth engaging when you operate in several States, your worker count sits near a threshold, or old licences are expiring and need fresh applications under the Code.

Is factory licence registration different in each State?

Yes. The OSH Code sets the framework, but each State, or the Central Government for its own establishments, designates the licensing authority and prescribes the form, fee and inquiry process. Applications in Gujarat, Haryana or Maharashtra can therefore follow different formats, and LexComply prepares each one in the format required.

Check My Applicability

Factory License by State

Under the OSH Code each State Government designates the authority that issues factory licences and prescribes the form, fee and inquiry, so a factory licence in Gujarat, Haryana or Maharashtra can follow a different route even though section 119 is the same everywhere.

  • 45 daysTo issue or deem issued, section 119(4)
  • 30 daysTo appeal an order, section 119(6)
  • 60 daysTo register a new establishment, section 3
