Trade License for Clinic Owners in Delhi and Mumbai

Opening or moving a clinic in Delhi or Mumbai raises one question first: does the municipal body license your premises at all? LexComply handles the trade license for clinic owners end to end, checking the municipal Act that applies, filing the MCD general trade licence where your premises is licensable, and lining up the fire NOC and chemist counter licence, so every permission is confirmed in writing and tracked on one register.

Our Clinic Trade Licence Services

Each clinic file starts with what the municipal Act actually lists, then covers only the permissions your premises needs.

Clinic Licence Applicability Check

We test your premises, its land use, any beds and any chemist counter against the municipal Act that governs it, from section 417 of the Delhi Municipal Corporation Act, 1957 to Schedule M of the Mumbai Act.

MCD General Trade Licence for Clinics

MCD's general trade list names clinics, dispensaries and pathology labs under section 417. Under MCD's April 2026 order, the fee is paid with property tax, and we confirm your premises is licensable before anything is paid.

Chemist Counter Licence

Selling medicines needs a drug licence of its own. Under an MCD order of 15 June 2026, chemist shops moved from health to general trade licensing, and Mumbai's Schedule M lists chemist and druggist shops for a section 394 licence.

Fire NOC for Clinic Buildings

Delhi's fire rules cover institutional buildings above 9 metres or of three or more storeys, and Maharashtra's 2006 fire Act lists hospitals and nursing homes, with maintenance certificates every January and July. We file the fire side too.

How LexComply Takes a Clinic From Address Check to Licence

Premises and Municipal Body Check

We confirm whether your clinic sits under MCD, NDMC or MCGM in Delhi or Mumbai, then read the land use, floor, beds and any chemist counter against that body's licensing schedule. The output is a written note on which permissions apply and which do not.

Document Preparation

We assemble what the authority asks for, including ownership or lease proof, occupancy and land-use papers, a site plan, identity records and the doctor's registration, and check each item against the authority's own published format before anything is filed, so queries do not stall it.

Filing the Trade Licence

Where MCD licenses your clinic premises under section 417, we file on the route MCD now uses, where the general trade licence fee is paid with property tax. We record each submission and receipt, because MCD treats that receipt as the general trade licence.

Fire and Chemist Permissions

We line up the permissions that sit beside the trade licence: the fire safety certificate where your building is covered, and the chemist counter licence where medicines are sold. Each one is filed in the right order, so a missing approval does not hold another back.

Tracking in Delhi and Mumbai

Every licence and certificate for your Delhi or Mumbai clinic moves into LexComply's compliance register with its due dates. Mumbai fire maintenance certificates fall due every January and July, and each date is tracked, so no permission lapses unnoticed across your sites.

Trade licence and fire NOC

How a Clinic Trade Licence Sits Next to Fire NOC

The two answer different questions. A municipal trade licence asks whether this use is allowed on these premises; a fire NOC asks whether the building is safe for it. Neither replaces the other. In Delhi, the Delhi Fire Service Rules cover institutional buildings above 9 metres or with three or more storeys, so a consulting room in a low building may need no fire certificate while a nursing home in a three-storey building does. In Mumbai, hospitals and nursing homes are scheduled buildings under the Maharashtra Fire Prevention and Life Safety Measures Act, 2006 whatever their height. LexComply maps both for your premises and files them in the right order.

Trade License for Clinic FAQs

What is a trade license for clinic premises?

It is the municipal permission to use specific premises for a listed trade or purpose. Whether a clinic needs one depends on the municipal Act that covers the address. In Delhi, MCD's general trade list under section 417 names clinics, dispensaries and pathology labs; other bodies, including NDMC and MCGM, do not list clinics.

Is a trade license for clinic premises required in Delhi?

It depends on the premises. MCD's general trade licence list names clinics, but its own brochure says clinics, dispensaries and diagnostic centres in residential plotted mixed-use premises are not licensable under section 417. In the NDMC area, the Ninth Schedule to the NDMC Act, 1994 does not list clinics. LexComply confirms which applies to your address.

Does a clinic in Delhi need an MCD health trade licence?

No. Clinics do not appear in MCD's health trade licence category list. MCD's June 2026 orders kept trades such as gyms, spas and lodging under the health trade licence and moved chemist shops to general trade licensing, and neither list names a clinic. In Delhi, the municipal licence that can apply to a clinic is the general trade licence.

Do I need a trade license for clinic premises in Mumbai?

Not under Schedule M. Part IV of Schedule M to the Mumbai Municipal Corporation Act, 1888 lists the trades that need a section 394 licence, and clinics are not among them. A chemist counter is, and a clinic with beds that admits patients registers as a nursing home with MCGM's Health Officer, which is a separate registration.

How does a trade license for clinic premises relate to fire NOC?

They are separate permissions. The trade licence concerns the use of the premises; the fire NOC concerns the building's safety. In Delhi, institutional buildings above 9 metres or with three or more storeys need a fire safety certificate. In Mumbai, hospitals and nursing homes are scheduled under the 2006 fire Act, with maintenance certificates every January and July.

What does MCD charge to license a clinic in Delhi?

Under an MCD order of 30 April 2026, the general trade licence fee is paid with property tax, at 15% of the total property tax, and the receipt is treated as the licence for that premises. LexComply's professional fee depends on the number of clinics and is quoted before work starts.

Does a clinic with beds need more than a trade licence?

Yes. In Delhi, the Nursing Home Cell of the Directorate General of Health Services registers facilities that run round the clock with at least 2 beds for admission, under the Delhi Nursing Homes Registration Act, 1953. In Mumbai, nursing homes register with MCGM's Health Officer under the Maharashtra Nursing Homes Registration Act, 1949. Both are separate from any trade licence.

Does the Clinical Establishments Act apply in Delhi and Mumbai?

Not yet. The Union health ministry lists the Clinical Establishments Act, 2010 as adopted in 19 States and Union Territories, which excludes Delhi and Maharashtra. Maharashtra introduced its own Clinical Establishments Bill in July 2026, which had not been enacted when this page was written. Registration under it would be separate from a trade licence.
