Trade License for Restaurant in Delhi and Mumbai

A trade license for restaurant owners now works differently in Delhi and Mumbai. Since 29 May 2026 MCD treats a valid FSSAI registration or licence as a deemed health trade licence for eating houses, and NDMC has done the same since February 2026, while Mumbai restaurants still apply to MCGM under section 394. LexComply confirms which municipal route applies, manages fire compliance where your premises needs it, and tracks every renewal.

MCGM Eating House Licence Under Section 394

In Mumbai an eating house needs a health licence under section 394 of the Mumbai Municipal Corporation Act, 1888. We prepare the application on the MCGM portal with proof of possession, premises documents and fire compliance.

How We Secure a Trade License for Restaurant Outlets

Outlet and Authority Check

We confirm whether your restaurant falls under MCD or NDMC in Delhi, or an MCGM ward in Mumbai, record its seating, floor area and kitchen fuel, and tell you in writing which municipal permission, fire approval and separate licences the outlet needs before you spend anything.

Premises File

We assemble proof of possession, premises authenticity documents, the floor plan, owner and partner details and your FSSAI registration number, then check each item against the checklist the municipal body publishes, so the application does not come back with a query on missing papers.

Fire Compliance

Where the outlet needs one, we prepare the fire NOC application or the codified fire compliance and undertaking, schedule the inspection, and brief your manager on extinguishers, exits, detection and kitchen suppression so the inspector finds what the drawings already show on site.

Municipal Filing or Deemed Licence

In Mumbai we file the section 394 application on the MCGM portal and answer the ward's queries. In Delhi we confirm the deemed health trade licence position, make sure the MCD or NDMC fee is paid, and keep the conditions you must still meet on record.

Renewal and Inspection Readiness

Every Delhi and Mumbai outlet then sits in LexComply's compliance platform with its licence, fire certificate, Form B dates and renewal deadlines, so each renewal is planned before it falls due and your team can show a valid licence at any municipal inspection.

When a Restaurant Owner Can File Alone

A single Delhi outlet under 90 sq m with a valid FSSAI registration may only need to confirm its deemed licence, pay the MCD fee and keep the documents MCD lists on the premises, which an owner can manage directly. Support earns its place when you open in both Delhi and Mumbai, when the floor area brings fire safety certification into play, or when an MCGM section 394 file needs fire compliance and renewal undertakings. LexComply then gives you a written route for each outlet, the filings prepared and every renewal tracked.

Trade License for Restaurant FAQs

What is a trade license for restaurant businesses?

It is the permission a municipal body gives an eating house to operate from a premises. In Mumbai it is the MCGM health licence under section 394 of the Mumbai Municipal Corporation Act, 1888. In Delhi, MCD and NDMC now treat a valid FSSAI registration or licence as the deemed health trade licence, with the municipal fee still payable.

Do Delhi restaurants still need an MCD health trade licence?

Not as a separate application. MCD's order of 29 May 2026 deregulated the health trade licence under sections 417, 420 and 421 of the DMC Act, 1957 for food businesses, so a valid FSSAI registration or licence is treated as the deemed licence. The deemed licence fee is still collected, and MCD continues risk-based inspections.

Does NDMC require a separate trade license for restaurant outlets?

No. NDMC's notification of 23 February 2026 says an existing establishment holding a valid FSSAI registration does not have to obtain a health trade licence from NDMC. NDMC still recovers the licence fee at its existing rates, its inspection team keeps monitoring hygiene, and an outlet without FSSAI registration is treated as unlicensed.

Is a Delhi Police eating house licence still required?

No. In April 2026 Delhi Police told the Delhi High Court that it is no longer part of the licensing activity for eating houses, its role having been dispensed with by a later notification. A restaurant serving liquor still needs an excise licence, which is a separate approval that LexComply does not file.

How do I get a trade license for restaurant premises in Mumbai?

Apply to MCGM's Public Health Department for an eating house licence under section 394, online through the MCGM portal. The application needs proof of possession, proof the premises is authentic and fire safety compliance. The Medical Officer of Health scrutinises it, a fire compliance officer inspects the premises, and the Health Department approves or rejects it with reasons.

Does a restaurant need a fire NOC in Delhi or Mumbai?

Often, yes. In Delhi, rule 27 of the Delhi Fire Service Rules, 2010 lists all assembly buildings, Delhi Fire Service has told the High Court it treats a restaurant with capacity for more than 50 people as one, and MCD expects a fire safety certificate from eating houses of 90 sq m and above. In Mumbai, MCGM needs a CFO NOC or codified fire compliance.

How long is an MCGM restaurant licence valid?

MCGM's conditions for the section 394 health licence allow it to be renewed for up to 5 years at a time. Running the eating house after the licence lapses makes the licensee liable to legal action, so LexComply tracks the renewal date and files the fire compliance undertaking that renewal requires.

Does a trade license for restaurant owners cover FSSAI and liquor?

No. FSSAI registration under the Food Safety and Standards Act, 2006 and any excise or liquor licence are separate approvals from separate authorities, and LexComply does not file them on this service. In Delhi your FSSAI registration is also what makes the deemed municipal licence work, so keep it valid.
