Gaurav JainIn order to ensure quick transport of Oxygen and to remove any hurdles due to compliances, Ministry of Road Transport and Highways vides its order dated 1st April, 2021 have exempted transport vehicles engaged in carrying oxygen to obtain permits , comply with conditions mentioned therein and other provisions of sub-section (1) of the section 66 of the Motor Vehicles Act, 1988 for the carriage of oxygen during the period of Novel Corona Virus (COVID-19) pandemic up to the 30th September, 2021. “(1) No owner of a motor vehicle shall use or permit the use of the vehicle as a transport vehicle in any public place whether or not such vehicle is actually carrying any passengers or goods save in accordance with the conditions of a permit granted or countersigned by a Regional or State Transport Authority or any prescribed authority authorising him the use of the vehicle in that place in the manner in which the vehicle is being used:

Provided that a stage carriage permit shall, subject to any conditions that may be specified in the permit, authorise the use of the vehicle as a contract carriage:

Provided further that a stage carriage permit may, subject to any conditions that may be specified in the permit, authorise the use of the vehicle as a goods carriage either when carrying passengers or not:

Provided also that a goods carriage permit shall, subject to any conditions that may be specified in the permit, authorise the use of the vehicle for the carriage of goods for or in connection with a trade or business carried on by him.

1[Provided also that where a transport vehicle has been issued any permit or permits, as well as a license under this Act, such vehicle may be used either under the permit, or permits, so issued to it, or under such licence, at the discretion of the vehicle owner.]”
